The terms on which we supply music and a commercial licence to your business.
Last updated 8 September 2026. These terms form a binding agreement between you and ListenJam Pty Ltd.
These terms apply when you subscribe to ListenJam. If you are subscribing for a business, you confirm you are authorised to bind that business, and “you” means that business.
ListenJam supplies streamed background music for commercial premises, together with a commercial licence to play that music publicly at the venues covered by your subscription, and a Music Licence Certificate evidencing it.
We may add, change or remove tracks and channels. The catalogue will vary over time. We do not guarantee that any particular track or channel will remain available.
New customers may start a 14-day free trial. We collect your payment details when you sign up. At the end of the 14 days your subscription starts automatically and we charge the plan you selected, unless you cancel before the trial ends. We will email you before the trial ends. We may withdraw or vary trial eligibility, and may decline a trial where an account has trialled before.
ListenJam is priced per venue, per year. A venue is one business premises. Your subscription covers one simultaneous audio stream per venue. That stream may play through as many speakers as you like within the premises, but if you need different music playing in different areas at the same time, each of those is a separate stream and needs its own subscription.
The published price is the same for every venue regardless of how many you hold. If you operate 20 or more venues, contact us for terms.
You must tell us each venue the music is played at, and keep that list accurate. Your certificate is issued per venue and names the premises it covers.
Subscriptions are billed annually in advance, or monthly if you choose monthly billing. Payments are processed by Stripe. Prices are in Australian dollars.
Your subscription renews automatically at the end of each term unless you cancel before it renews. We will email you before an annual renewal.
If you add a venue mid-term, we charge a pro-rata amount for the remainder of the term and the new venue joins your existing renewal date.
If we raise our prices, your existing subscription keeps the price you signed up at for as long as it renews continuously. A price rise applies to new subscriptions and to any venues you add after the change. If we ever need to change the price on an existing subscription, we will give you at least 60 days notice by email before it takes effect, and you may cancel before then.
You can cancel at any time from your account. Cancellation takes effect at the end of your current billing term, and you keep access and your licence cover until then. We do not give partial refunds for unused time on an annual term except where the Australian Consumer Law requires it.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded. If the service fails to meet a consumer guarantee, you may be entitled to a refund, replacement, or compensation for reasonably foreseeable loss.
While your subscription is current and paid, we grant you a non-exclusive, non-transferable licence to publicly perform the ListenJam catalogue as background or foreground music at the venues covered by your subscription.
If you play music from other sources at your premises, you may still need a licence from a collecting society for that music. Our licence covers our catalogue only.
Send it to us. Where the enquiry concerns music we supplied at a venue covered by your subscription, we will respond on your behalf. Your certificate is your evidence that the music we supply is licensed. The indemnity we give you, and its limits, are set out in the Music Licence Agreement supplied with your certificate.
If the venue details you give us materially misstate the premises, the licence and any indemnity may not cover you for those premises.
The ListenJam catalogue, website, player and brand remain our property or that of our licensors. Your subscription grants a right to use the service and to perform the music publicly as described above. It does not transfer ownership of anything.
We aim to keep the service available continuously but do not guarantee uninterrupted access. We may carry out maintenance, and may suspend the service where necessary to protect it. Support is by email at hello@listenjam.com, and we aim to respond within one business day.
Subject to the Australian Consumer Law and to the indemnity given in the Music Licence Agreement, we are not liable for indirect or consequential loss, loss of profits, loss of revenue, or loss of goodwill. Our total liability arising out of or in connection with these terms is limited to the amount you paid us in the 12 months before the claim arose.
We may suspend or terminate your subscription if payment fails and is not resolved after notice, if you breach these terms, or if we are required to by law. If we terminate for reasons other than your breach, we will refund the unused portion of your term. Your licence to play the music ends when your subscription ends.
We may update these terms. If a change materially affects your rights we will email account holders at least 30 days before it takes effect. Continuing to use the service after that date means you accept the updated terms.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
