Privacy Policy

How we handle personal information, and what rights you have over it.

ListenJam Pty Ltd (ListenJam, we, us) provides licensed background music to businesses. This policy explains what personal information we collect, why we collect it, who we share it with, and how you can access or correct it.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. What we collect

Account and contact information

Your name, business name, email address, phone number and password. If you are acting for a business, we also collect your role or authority to enter the subscription.

Premises information

The trading name, address and venue type of each venue where you play our music. We need this because your Music Licence Certificate names the specific premises it covers. Without it we cannot issue a valid certificate.

Billing information

Subscription plan, number of venues, billing history and invoices. Card payments are processed by Stripe. We do not receive or store full card numbers — we hold only the last four digits, card brand and expiry so you can identify your payment method.

Service usage

Which channels you play, playback times and duration, and the devices you stream from. We use this to operate the service, to reconcile royalty-free catalogue usage, and to evidence what was played at your premises if a collecting society ever asks.

Technical information

IP address, browser and device type, operating system, and pages visited on our website. Some of this is collected automatically.

Support communications

Emails and messages you send us, and our replies.

2. How we collect it

Most information comes directly from you — when you start a trial, subscribe, add a venue, or contact support. Some technical information is collected automatically when you use the website or the player. We may also receive information from Stripe about the status of a payment, and from a distribution partner if you were referred to us by one.

3. Why we use it

  • To provide the music service and keep your account working
  • To issue and renew your Music Licence Certificate for each venue
  • To bill you, take payment and send invoices and receipts
  • To respond on your behalf if APRA AMCOS, PPCA or OneMusic Australia contacts you about music played at your premises
  • To provide customer support
  • To send service messages such as renewal reminders, certificate expiry and billing failures
  • To send marketing about ListenJam, where you have not opted out
  • To detect and prevent fraud and misuse
  • To improve the catalogue and the product
  • To meet our legal and record-keeping obligations

You can opt out of marketing at any time using the unsubscribe link or by emailing us. You cannot opt out of service messages while you hold a subscription, because they concern your licence and your billing.

4. Who we share it with

We do not sell personal information. We disclose it only to:

  • Stripe — to process payments and manage subscriptions
  • Hosting and infrastructure providers — who store and serve the service on our behalf
  • Analytics and email providers — to understand website use and to send service and marketing email
  • Collecting societies — only where you have asked us to respond to an enquiry on your behalf, and only the information needed to do so
  • Professional advisers and insurers — where relevant to a claim or an indemnity we have given you
  • Law enforcement or regulators — where we are required or authorised by law
  • An acquirer — if our business is sold or merged, subject to this policy continuing to apply

5. Overseas disclosure

Our infrastructure is primarily hosted in Australia. Some of our service providers — including Stripe, and our hosting, analytics and email providers — store or process data in the United States and the European Union. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the APPs.

6. Cookies and analytics

We use cookies and similar technologies to keep you signed in, remember preferences, measure how the website is used, and measure the effectiveness of our advertising. You can block or delete cookies in your browser, but parts of the service may stop working correctly if you do.

7. Security

We take reasonable steps to protect personal information from misuse, loss, and unauthorised access, including encryption in transit, access controls, and limiting staff access to what is needed. No system is completely secure, and we cannot guarantee absolute security. If a data breach occurs that is likely to cause serious harm, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme.

8. How long we keep it

We keep personal information only as long as we need it.

  • Account and billing records — for seven years after your subscription ends, to meet Australian tax and corporate record-keeping requirements
  • Licence certificates and playback records — for seven years after the certificate period ends. These are evidence that your premises were licensed at a given time, and are the records we would rely on to defend an indemnity claim
  • Support correspondence — for two years
  • Marketing contacts — until you unsubscribe

9. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong. Email hello@listenjam.com. We will respond within 30 days. There is no fee, though we may charge a reasonable cost for a large or repeated request. If we refuse access or correction, we will tell you why in writing.

You can ask us to delete your account information. We may need to retain some records for the periods set out in section 8 where the law requires it.

10. Complaints

If you think we have breached the Australian Privacy Principles, email hello@listenjam.com with the details. We will acknowledge within five business days and give you a written response within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner: oaic.gov.au, or 1300 363 992.

11. Changes to this policy

We may update this policy. If a change materially affects how we handle your personal information, we will email account holders before it takes effect. The date at the top shows when it was last updated.
